Terms of Service

1. Acceptance of Terms

By accessing or using the Hoops Draft platform, you agree to be bound by these Terms. If you do not agree, you must exit the site immediately. Your use of this service following any changes constitutes acceptance of those modifications.

2. Description of Service & No Gambling Disclaimer

Hoops Draft is a Software-as-a-Service (SaaS) platform providing draft hosting and scoring tools for private entertainment.

  • No Prize Distribution: Hoops Draft does not facilitate, handle, or distribute any wagers, bets, or prize money.
  • Software Access Fee: The $16.00 fee is solely for access to the draft software and hosting services.
  • Game of Skill: Our platforms (Seed Points, Body Snatcher, etc.) are strictly games of skill based on user knowledge and strategy.

3. Eligibility & Age Restrictions

Minimum Age: You must be at least 18 years of age to create an account or join a league. In some jurisdictions (e.g., AZ, MA, LA), the minimum age may be 21.

Verification: We reserve the right to verify your age and eligibility at any time. Failure to provide proof of age will result in account termination.

4. Fees and Refunds

Access Fees: All fees for software access are billed in advance.

No Refunds: Once a draft has been finalized or the 'Draft Room' has been entered, all software access fees are strictly non-refundable.

5. User Responsibilities & Conduct

  • You are responsible for maintaining the security of your account and password.
  • You agree not to use the service for any illegal purposes or to compromise the site's security.
  • Users may not 'co-own' accounts or create multiple accounts to circumvent draft rules.

6. Limitation of Liability

Hoops Draft is provided 'as-is.' We are not liable for any losses, including but not limited to server outages, data errors, or 'stat corrections' provided by third-party data providers.

7. Governing Law

These terms are governed by the laws of the State of Nebraska. Any disputes shall be settled via binding arbitration.

8. Intellectual Property

The Hoops Draft platform, including but not limited to its source code, scoring logic, algorithms, design, and user interface, is the exclusive proprietary property of Hoops Draft. Users are strictly prohibited from copying, modifying, reverse-engineering, decompiling, or distributing any portion of the software or its underlying logic for any purpose without prior written consent.
